Abstract

This research is a quantitative research conducted by collecting and analyzing documents and interviews of those concerned. The objective is to study problems from life insurance being sold through commercial bank by bank employee who acts as a solicitor or an offerer of life insurance for sale, which cause effects on customer. The study found bank employees perform the duty of a life insurance broker by committing a fraud to lure customers into buying a life insurance policy. The method used is to intentionally or neglectfully present unclear information and false information and conceal material facts by claiming that it is a deposit with higher rate of interest than normal. Customer, therefore, is deluded and decides to buy life insurance. Afterwards, when customer wishes to make a withdrawal at the commercial bank, he/she cannot do so from the account in the same manner as traditional saving accounts as it violates the life insurance policy terms and conditions. Consequently, this cause impacts and damages to customer. Although, at the present time, Life Insurance Act, BE 2535, Additional Amendment (No.2) BE 2551, a legal measure, is in active to regulate life insurance brokers,it lacks effectiveness in tackling the problem. Investigator’s suggestion, Thailand’s Life Insurance Act, BE 2535, Additional Amendment (No.2) BE 2551, should likewise impose penalties similarly to the Law of Singapore in order to set definite measures which can correct and regulate life insurance broker from commercial bank.
