การกำหนดระยะถอยร่นสำหรับชายฝั่งทะเลตามกฎหมายของต่างประเทศ ESTABLISHMENT OF COASTAL SETBACK LINES IN FOREIGN COUNTRIES

Abstract

บทความนี้มุ่งศึกษาเรื่องการกำหนดระยะถอยร่นสำหรับชายฝั่งทะเล โดยในเบื้องต้นพิจารณาถึงการบริหารจัดการพื้นที่ชายฝั่งทะเลแบบบูรณาการโดยการกำหนดระยะถอยร่น จากนั้นได้ศึกษาถึงการกำหนดระยะถอยร่นสำหรับชายฝั่งทะเลตามกฎหมายของต่างประเทศ ผลจากการศึกษาพบว่า การกำหนดระยะถอยร่นสำหรับชายฝั่งทะเลเป็นแนวทางการจัดการพื้นที่ชายฝั่งทะเลที่มีความสำคัญอีกวิธีหนึ่ง ซึ่งได้รับการยอมรับอย่างกว้างขวางว่าสามารถนำมาใช้เพื่อจัดการทรัพยากรชายฝั่งทะเลเพื่อคงอยู่อย่างสมดุลและยั่งยืน ในหลายประเทศจึงบัญญัติให้การกำหนดระยะถอยร่นเป็นมาตรการทางกฎหมายอย่างหนึ่งในการบริหารจัดการพื้นที่ชายฝั่งทะเลของตน โดยมีรูปแบบ ประเภท และวิธีการที่แตกต่างกันไป ทั้งนี้ขึ้นอยู่กับลักษณะของพื้นที่ชายฝั่งทะเล ลักษณะการใช้ประโยชน์จากพื้นที่ชายฝั่งทะเล และวัตถุประสงค์ของการกำหนดระยะถอยร่นในพื้นที่ชายฝั่งทะเลจึงเห็นได้ว่าการกำหนดระยะถอยร่นสำหรับชายฝั่งทะเล นอกจากเป็นการวางมาตรฐานขั้นต่ำในการคุ้มครองพื้นที่ชายฝั่งทะเลแล้ว ยังเป็นการปกป้องคุ้มครองสิทธิในการเข้าถึงการใช้ทรัพยากรชายฝั่งของประชาชน และเป็นการสร้างแผนงานทั่วไปเกี่ยวกับการจัดการพื้นที่ชายฝั่งทะเลแบบบูรณาการในขณะเดียวกันด้วย

This article aimed to study the establishment of coastal setback lines and to propose the use of coastal setbacks for integrated coastal zone management. The legal framework for the coastal setback lines in foreign countries were investigated. The study revealed that the establishment of coastal setbacks has widely been accepted in coastal zone management for managing coastal resources in a balanced and sustainable way. Several countries have adopted coastal setbacks as a legal measure for managing their coastal resources, however, with diverse forms, categories and methods for determining coastal setback lines. The identification of coastal setbacks depends on the characteristics and the use of coastal areas, as well as the objective in determining coastal setback lines. Therefore, the establishment of coastal setbacks is not only necessary as a minimum standard for coastal protection, but also a safeguard for the public rights to access the shoreline. At the same time, it also creates a general guideline for integrated coastal zone management.
