Abstract

 


The study of Local Administrative Contract: A Case Study on Guildlines for Administrative Contract under the Notification of the Decentralization to the Local Government Organization Committee aimed to study the theory about local administrative and local administrative contract in terms of public services management, principle of law about administrative contract in foreign countries, Thai general principles for administrative contract arrangement and guildlines for administrative contract arrangement under the notification of the Decentralization to the Local Government Organization Committee, and finally to find the proper guildlines for local administrative contract arrangement and dispute resolution.


The qualitative approach is analyzed for this study with methodology of documentary research by collecting data from legislation, journals ,and other documents for studying the administrative contracts under the notification of the Decentralization to the Local Government Organization Committee


The result of the study found that Thai local administrative contract in terms of public services management in form of co-ordinate administrative contracts are conducted under the notification of the Decentralization to the Local Government Organization Committee. Because this notification has recently been enforced, so it is incomplete in three issues; fair benefits among contract parties, early contract withdrawal and termination, and disputes resolution between contract parties or third parties. The result of this study suggests that the administrative contract arrangement should concern about public benefits more than benefits among contract parties, contents regarding contract termination should be revised, process on dispute resolution should be revised and clarified such as disputes between contract parties or disputes between third parties
